This is for an american gov. paper for school, and I’m supposed to ask for people’s opinions on questions like this one…so if you would be kind enough to help me out, I would really appreciate it.

I think there should be a limit on the pain and suffering part. People are greedy and try to claim far more than they are entitled to in this category.

All costs associated with the medical procedures and law suit (assuming you win) should be covered as well as "something" for pain and suffering.

However; I would like to see stiffer penalties levied on the doctor’s ability to continue to practice if found guilty. Probation to a medical board, loss of license to practice etc. should become the penalty rather than insurance companies paying out huge sums.

Hit ‘em where it hurts… their livelihood.

In a motor vehicle accident, I received a settlement for personal injury. Is the portion that is noted as wage loss/medical to be claimed on my income taxes as other income? Is it the full amount and what documents do I attach to support it?

Compensatory payments are not taxable. The amount for punishment to the defendant is taxable.

I’m 20 years old, female and walk with a pronounced limp.

I was born with Hip Dysplasia (dislocated hip) on the left side. When i was 8 to 12months old (not quite sure) I was given the standard procedure of having the hip pushed back into place and put into a plaster cast for two months, to set the socket.

During the time i was in this plaster cast my consultant retired and was replace by a new doctor. Through some mistake i was left in the plaster cast for 4 weeks longer then i should have. This resulted in Avascular Necrosis, which is a condition where the bone/socket dies caused by lack of blood circulation. This, to me, means that someone where along the line, negligence caused this.

This is where this gets tricky. My father, at the time, was a consultant at the same hospital, knew my consultant very well and therefore no lawyers or medical negligence claim was put forward. (my father didn’t want to cause trouble)

I have numerous surgical procedures, including bone grafts, traction, the socket plated and pinned, and most recently a proceedure where they broke my bone, pinned it and then lengthened, by 1mm a day.

They have discussed hipe replacement as the next step, as none of the other precedures have had much effect.

Because this happened so long ago…can i still make a negligence claim? My older sister has the exact condition but she has perfect walking. I also know this condition is fair common, with 1 and every 1,000 babies born with Dysplasia.

Sorry for such a long winded explaination, but any help on this would be really very appriciated.

The statute of limitations in your situation starts to run when you turn 18. So you have to file your claim within 2 years of turning 18. Beware though that most states require one to give notice to the doctor and hospital at least 6 months before filing a lawsuit, which could significantly affect your ability to prevail. Find and consult the best medical malpractice attorney in your area.

my injury is almost 2 years old now- how long before settlement with lawyer and how much cash can i expect? im shooting for lifetime medical and my lawyer going for depression too? thanks- mike

More information is needed.
Every state has their own way of calculating worker’s comp benefits.

You say you are shooting for lifetime medical. The value is typically determined by the average cost of treatment per year ( at a reduced rate) multiply by your life expectancy. So your age plays a factor.

In addition, depending on where your case is located, permanent disability can be rated in various ways. Typically it is either rated by work restrictions or by the impairment guides under the American Medical Association.

No, because sometimes medical negligence can have serious consequences for the patient. I studied a case in college where a woman was left in a permanent coma after a routine appendix operation.

In California, I’ve filed a personal injury auto accident claim and need to release my medical records to the insurance company. I’m only claiming physical injury, not psychological/emotional but the doctor who is treating me for pain with alternative treatments such as biofeedback is also my therapist. His notes from our appoinments contain co-mingled info and I don’t want to submit my personal mental health information. His physical pain treatments are important to my case and I’d like to know if there is a way around this?

Considering you’ve asked this question at least twice now, sounds like there is something you are trying to hide.

So what if you are mentally disturbed. If that is not related to the injuries you sustained in the accident, the insurance company is not going to care what those records state.

Due to complications after the birth of my third child I needed a partial hysterectomy. After a meeting with hospital executives today we have a solid case of negligence. If I was to seek legal council where would I start and what sort of lawyer should I consult.
I heard that some lawyers will take a case on and will bill you at the end providing you win of course and then proceed to take the whole of the settlement? Need some suggestions if I could. I live in Sydney, Australia

I ask this stupid rhetorical question, because I don’t get why they want the government to regulate health care. Yes it is regulation since they will dip their hand in insurance, then it spreads like cancer to everything else.

I’d rather let the doctors do as they please. The doctors intentions are to help as many sick patients as they can. Remove lawyer law suits and other trash that damages doctors practices. Let the doctors run the medical field. Not the bureaucrats.

Insurance companies currently force you to go to accountants and lawyers for medical advice.

This fellow Andrew Speaker ignored medical advice and flew to Europe, then while there finds out that he is really contagious with a very dangerous form of TB.
Is this about what you would expect out of a Trial Lawyer?

I’d get a lawyer and sue him!!!!
