What’s the time limit in filing a medical malpractice, workers comp or most law suits.?

I just need to know the time limit. I do not know what kind of website to look at to find this. If someone knows when I can look to find the time limits please tell me.

two years in most states. but if you are still seeking medical attention for the injury, then the LAST date of your medical attention is the day the two years begins. So if you injured yourself and you saught medical attention for it on aug 3, 2005 then your limitation expired, if you go in and continue to seek medical attention, and you currently still are, then it doesnt expire. it’s BEST to seek legal advice while you are seeking medical attention. hope that helps.

my insurance does have personal injury protection coverage, but my agent said they might raise my premium and i dont want that, because the accident wasn’t my fault.
if the driver at fault’s insurance doesn’t pay my medical bills(i had my head, neck checked, i still have headache and neck pain), then who will pay my medical bills? i don’t know how much i need to pay for all the medical bills and drugs. thank you.

i have farmers, he has safeco. police report filed, no one got a ticket. i live in texas if that helps.

If the accident is no fault, then you or your insurance carrier pays your own bills. However, if you feel the other driver was negligent, you can sue him directly. Have yourself checked out, get the necessary treatment and sue him. That’s all you can do really. Sorry to hear about the accident. Hope you feel better soon.

Running up against lawyer barriers in a Medical Negligence/Malpractice issue.?

My mother passed away last month due to gross medical negligence/malpractice. She went to a county run health clinic. I am being told by attorneys that they wouldn’t make enough money on the suit for it to be worth their while due to federal regulations on settlement amounts. I have googled, but apparently, I have not put in the correct search terms. Could someone please tell me what these are, and if it would be possible for me to persue action myself?

You have been contacting lawyers that work under contingency where you don’t pay them they take a % of the settlement.If they don’t think there will be a settlement they will not take the case. The only way you could do this is to hire a lawyer that you pay by the hour which is very expensive.

How could if find a lawyer that specializes in medical malpractice, in particular instruments that failed.?

If i wanted to find a lawyer in San Diego california to help in a medical malpractice suit how would I do it. The doctor did a routine surgery and the instrument failed and I was in a coma for 3 months, icu 87 days and in the hospital a total of 6 months. The doctor blames a tool for the problems.

The surgery was on May 2, 2006, what are my options, who could handle this.

I am crippled and in utter pain from this surgery. I was perfect before

Can I file for workman’s comp or short term disability due to a medical injury while working?

I have been off work since Jan. of this year due to a foot injury. I had a bad heel spur with a fracture. Also a gangleane cyst which I have yet to treat. I have worked on my job for almost four years. My job requires me to be on my feet and do some heavy lifting. Also daily typing and use of my hands. I was working when all of these injuries happened but did not know about workman’s comp. I spoke with a lawyer who said it may be hard to prove as an on the job injury but will need all my medical papers to prove. Also had a baby a year ago which also put more pressure on my feet and body to the point where I was swelling and had a pregnancy condition called edema. My job was paying me but only for one hundred and fifty days. That has now run out so now I have to give up my job insurance cause I can’t afford to pay anymore. I have two kids to support and was suppose to be married at the end of June. How am I suppose to do any of that now? Just had surgery. Please help me?

Check with your Department of Labor in your state and hopefully you havent gone past your time limit of filing.

I got into a car accident w/ a motorcyclist back in Feb 09′ . I was just curious what the statue of limitations is in California. If he wants to file a civil suit for medical and hospital bills. How long does he have to do this???

California has a 2 year tort Statute of Limitations.

?? NO idea. For some people, full coverage means minimum liability, collision and comp. For others, it means minimim limits of all available coverages, collision and comp. Still others, it’s maximum limits of some coverages, or maximum limits of all coverages, etc.

You need to talk this out with your agent. "Full coverage" can mean a great variety of things.

I am looking for a go get ‘em kind of medical malpractice/negligence lawyer in Austin. My mother passed on June 5th due to medical malpractice/negligence at the age of 62. I have tried the lawyer referral service, but it doesn’t take into account the attorney’s workloads or their want to take on a tougher case. I have tried looking it up online, but again, I spend a lot of time on the phone with people that don’t want to spend the time necessary for the case, but would rather take a quick 1 week settlement. Any suggestions?

You might have to dig into your pocket on this one. This is not the easy money kind that they like.

My daughter has just suffered a debilitating stroke while being given an IV at the hospital. They failed to treat her stroke at the hospital for two days probably meaning that the damage is now not reversible. She has a two year old infant daughter to take care but she is paralyzed on the left side of her body.

How can I find a lawyer willing to help me sue a college for not abiding by the ADA and causing me injury?

I was actively recruited by Lyon College in Batesville, Arkansas in the summer of 2005. I applied and was accepted. They knew that I was very disabled and needed to have a private room on the bottom floor. I was given a room on the second floor of the dorm, which didn’t have an elevator. I was walking up and down stairs multiple times a day for several weeks until the college finally found me a room on the bottom floor. During this time I developed a sore from walking so much, and it ended up getting massively infected. I had to drop out of the college during my second semester there. I filled out the paperwork to get medical leave, and had thought I received it. I was just informed a couple of weeks ago I never received medical leave. After a year and a half of missing school and undergoing multiple surgeries and I.V. antibiotics because of the sore I developed because of Lyon’s lack of ADA compliance, I would think I have a case. However, I can’t find a lawyer? Who can help me?

I am not sure you can do much..you kept living there–even though you told them you needed a lower floor. Kinda your loss. You never actively pursued justice before moving. Sorry.
